The pro-illegal immigration leftists and liberal Media are misrepresenting the latest court ruling on DACA (Deferred Action for Childhood Arrivals) as a Trump Defeat, but it is a delay at best. The judge ruled President Trump and his administration simply have to explain their decision to end the program better.
A George W. Bush appointee, does NOT hold that the Trump administration lacks the authority to rescind DACA. Rather, it says the administration's justification for ending the policy is insufficient under the Administrative Procedure Act, which states that courts "shall . . . hold unlawful and set aside agency action . . . found to be . . . arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law." Judge Bates noted a "non-trivial" possibility that the administration would be able to remedy his concerns by providing an alternative rationale, which means the matter could be solved with an in depth explanation.
