Texas Attorney General Ken Paxton is investigating the city of San Antonio for potential First Amendment violations after the City Council voted to prevent Chick-fil-A, from opening a location in the city’s airport. At the heart of the SA city government’s action against Chick-Fil-A is the City’s “Non-Discrimination Ordinance” (NDO) that demands and forces "diversity" and " inclusion" in all matters the City touches.
Democrat TX state representative and former city councilman Diego Bernal authored the NDO that demands "inclusion" or else of everyone and everything. Many felt then, and certainly feel now, the NDO violates the First Amendment.
The NDO was extremely controversial, and there was considerable opposition against it. However, rather than hold a popular city-wide vote, the city council led by then-Mayor Julian Castro voted to pass the ordinance.
